Legal Action

This page documents all legal action taken in connection with the failed Spank My Monkey marketing campaign. (For more information, see: The Full Story.)

  • DMCA Takedown Notice
On August 25, 2006, YouTube, Inc, acting on a third-party notification by Dodgy Monkey Media, LLC, issued a DMCA Takedown Notice over the Anti-Christ of the Hot Rod World parody video, produced by Hotrodders.com. The video was then removed from YouTube, and hosted on a specialty free-speech server. A screenshot of the DMCA Takedown Notice is available below. • Cease-and-Desist Notice
After pulling Richard Rawlings's episodes of the television show Overhaulin' from the air, Discovery Communications claims to have issued a Cease-and-Desist Letter to Gas Monkey Garage over the unauthorized use of the Discovery Channel logo and the Overhaulin' logo on GasMonkeyGarage.com. Both logos were eventually removed from GasMonkeyGarage.com. Before and after screenshots of GasMonkeyGarage.com are available below. Click on the thumbnail images for full-size versions. • Discovery Demands Removal of Board of Directors from SpankMaker
A lawyer for Discovery Communications, Inc., the parent company of The Learning Channel, has demanded that SpankMyMarketer.com remove the photo of the Discovery Board of Directors from The SpankMaker, the tool used to make parody comics of the marketers associated with the failed Spank My Monkey/Anti-Christ marketing campaign. Discovery claims that it infringes their copyright, and is used to defame their company. The Electronic Frontier Foundation (EFF) provided pro-bono legal support to SpankMyMarketer.com, to defend against Discovery's baseless legal claims. (For more information, see the EFF press release: Media Giant Bullies Internet Critic.)

  • Discovery Backs Down from Baseless Legal Claims
After their attempts to silence SpankMyMarketer.com were exposed in the press, Discovery Communications was forced to back down from their baseless legal claims. (For more information, see the media page.)
